Hello,
Can anyone advise on a detailed guide to the Working Time
Directive which includes examples, I am struggling to locate anything that is
of any ilk off the internet. I also pose the following questions:-
What contraventions if any are caused by someone generally
working 8 hours a day & then suddenly on a rare occasion working an
additional 8 hours to make a continuous shift?
To confirm that Employees are to have 11 consecutive hours
rest in any 24-hour period (commuting/driving to work is not counted as work
and therefore is considered as rest time).
If an employee works a 12 hour shift and then drives home (approx.
2 hr drive) is this OK?

Forget the WTR for a moment, the whole point of these regulations are to ensure workers do not work uneccesarily and dangerously long hours. Doing a double shft is likely to cause fatigue which can also cause accidents in the workplace and on the road.
As a general rule time spent travelling to and from work is not normally included except in the case of excessive hours which the employer has condoned. There was a case a few years back where an employer was prosecuted for allowing an employee to work long hours and to drive home - citation escapes me.
Some employers build in driving to and from work in the working day, although this is not the norm, and insist employees have at least 12 between shifts including driving to and from work.

WTD is normally or can be based over four weeks so you will work more hours in one week than an other but it ballances out over the four weeks. If it is occasional working then besides the safety issue of driving home there would not really be an issue.
There is a lot of work where you would not always have 11 hours between shifts, nureses, DR's, care homes, prisons etc the time taken in these areas is dependent on what is happening when you are about to go home, look at the recent bombings particularly manchester nurses, police etc called in I bet not all of them had 11 hours between the shift, I would bet that quite a few never went home at all for 24 hours. Would we argue that they cannot be called in or asked to stay on in these circumstances because they hadn't had 11 hours between the shift. I think what we need to do is look at the circumstances and then judge.
