Hi all, I have a a few questions. An employee was away on a course but during the evening (After the course had finished) he had gone out for dinner. Following his meal he decided to go and visit some local bars. At approximately 1.30 am he claims to have fallen down and broken his shoulder. Are we Liable? Is this RIDDOR reportable?

Cheers Ray, my thoughts exactly. My manager seems to thinks its a reportable accident but having said that he's had no relevant H/S training.

Out of interest, did the manager say why he thought it might be reportable?

Unless he was given a work instructoin to prop up a bar until 1.30am the answer is no.

No it isn't reportable, he wasn't at work and this did not arise out of his working duties.

I agree it's not reportable, but in otehr jurisdictions....
