Hi, I am hoping someone will be able to give me a bit of help with this please. There are two separate diamond drilling companies. One Irish and one UK. They are owned by the same people and the UK company will use the Irish companies name as its trading name. The Irish company has been established for many years, has over 20 skilled operatives and has full evidence and practical examples, whereas the UK company is just over a year old and has only 4 desk based staff and hasn't won any contracts yet. The UK company don't want to start employing skilled operatives until they've won contracts, so will call upon the Irish operatives initially. Can they go through as under 5 employees and say the Irish company will be a subcontractor? Or do they need to have the Irish operatives on their payroll and go as over 5 employees? Even if one of these is possible, inductions carried out, cscs cards obtained, risks assessed and control measures identified and measures put in place and documented etc there will be no evidence of it being implemented on site in a practical real life situation because they need CHAS to get the work!! What do new companies do in this situation? It's hard enough competing with the big companies, but without accreditation they are unlikely to be able to tender for the contracts they need. What are your thoughts please?

Hi,
Why not just register the UK operation as a UK Company – Business i.e. XXXX (UK).
From what you have said you will then trade as less than 5 and engage contractors as you so wish.

Thanks very much for your reply.
The UK operation is already a UK company. So there is Company A registered in Ireland and Company B registered in the UK but 'trading as Company A' if that makes sense.
So yes they are currently under 5 employees and can engage with the Irish (company a) and hire them as Contractors, but because the UK company haven't yet won any business they have no practical evidence and I'm wondering if this will potentially be a problem.
I may call CHAS tomorrow and see if they can advise, but from what I've read they're not the easiest to engage with.

Hi,
I wouldn't have thought that using Company A existing practical example documentation would be a problem.
You would have to adjust them so that they are seen as one of your existing contractors.
Best to just confirm with CHAS though - ask to speak to an accreditation manager.
