Is it a realistic prospect, to monitor and audit health and safety regulatory compliance of UK Manufacturing Plants, from an international office based in Mainland Europe, by someone who may not be entirely au-fait with UK HSE Regulations?

My feeling is that as long as the auditor is an HSE Specialist at least in mainstream EU Regulations, there is not so much of an issue applying the knowledge to the UK position - it would not be so difficult to adapt.

Anyone have any other opinions? Anything specific that would make the scenario not a viable proposition?

Although the Regs are in theory the same there might be a number of differences that the person needs to be aware of:

  1. Enforcement responsibilities- in parts of Europe, insurance providers take the lead on accident investigations not. The unions might have a more active role as well.
  2.  Interpretation of regulations – in most of Europe legal precedent is not an issue and so how the Regs are interpreted(and by whom) may vary
  3. Civil compliance is different with most countries relying on a fixed compensation scheme than having to go to court to sue for negligence.
  4. The culture might be different- this might particularly be the case in Eastern Europe where there is some hang over from communist days. They may for example offer ‘danger money’ and the like for workers who agree to lesser controls (they might expect this sort of pay out and be narked if it is not offered because you decide to control the risks instead!)  

Lots of other things as well but if the person is aware of this and takes it into account then of course they can work across the EU. Of course when we leave, it is anybody’s guess what will happen (I know promises have been mad but there is nothing set in stone YET)

Always nice to read some specifics, as I am trying to justify a position, one way or the other. I have no clear arguments for or against at the moment, only the general feeling that it should be OK.
