If it has just been discovered that a contractor has used an ACM (ie asbestos cement sheet) during a construction project in 2010 is this reportable to the HSE? If so how?

Not 100% sure but I would have thought as a breach of the Asbestos Regs, or RIDDOR "the accidental release of any substance which could cause injury to any person". My advivce would be to contact your local HSE or LA.

Pretty sure the breach is of The Asbestos (Prohibitions) Regulations 1992 (as amended).  That is where the ban on import and supply was created.

An Aussie hospital had this fun a couple of years back as I recall when it turned out materials from China were actually ACMs.

The law is made under the Act so the relevant enforcing authority is as per normal.  No obvious category under RIDDOR but pretty sure they'd like to know!  So might Environment Agency - presumably a bit of 'recycling' going on?

Thanks for the replies. It's definately asbestos cement that's been used in 2010. 

Presumably it needs to reported to HSE as when installed contrcators operative will not have taken precautions when cutting and drilling thinking there was no asbestos risk?

Also, given that there was (almost) a total ban in 1999 the contractor and/or supplier have acted illegally. Wouldnt the HSE want to know about this for a possible prosecution?
