Hi All,

Member of our staff was injured at work, self certified for 7 days and returned for work on the 8th day. Would you class this as reportable? The regulations say over 7 days and as they were off for 7 days only, i am inclined to not report this?

Your interpretation is right.  7 days only is not reportable, it takes 8 days (excluding the day of the accident) to become reportable.

What happens if you have a man that chooses to extend his time off after the hospital has given him the green light to return to work but as he's self employed he can take as much time off as he likes  if he wants to.

Does that still make it riddor

It is fitness for work that counts, not attendance at work.  If someone is fit for work but on holiday then the holiday doesn't count towards the lost days.

Yes Correct

Of course, if day 8 falls on a weekend which is normally a day off, and they return to work on the Monday you have to check if they were capable of working on the weekend (not if they wanted to but capable of doing the full range of normal duties or did they miraculously get better Sunday evening). If they were ok on the weekend get them to sign something to that affect for posterior covering purposes.

When he self certified was this after seeking medical opinion? ie hospital A&E. They may have said fine but he may have taken time off to be fully fit to return to work.

If as a result of an injury an injured person isn't fit to do all aspects of their normal job, then those non-fit days are counted towards the RIDDOR period regardless of whether a doctor said they could go back to work or indeed whether they do go back to work on restricted duties.  It is fitness that is the criterion not certification.
