What happens if you have a man that chooses to extend his time off after the hospital has given him the green light to return to work but as he's self employed he can take as much time off as he likes  if he wants to.

Does that still make it riddor

I think you would need to establish if he was incapacitated for work during that additional period or just wanted a bit of a break.

Agreed. It would only make it reportable if he was taking the time off because he was still incapacitated. If it was just because he wanted time off (non-illness related) then that would not be classed as riddor reportable. 

Riddor applies to employees, the self employed, trainees and contractors. If he's in any doubt and still feels unwell despite the green light he should discuss this with his GP and get formally signed off if GP deems it necessary. 

Riddor is reportable for being away from work for more than 3 consecutive days - over 3 day injuries dont need to be reported, unless incapacitation goes on to exceed 7 days.
