Maximum hours / consecutive days allowable after work time opt out ?
Rank: New forum user
|
Hello all First time using a safety forum, so please be gental.
My question is about maximum working hours per day and the allowable number of consecutive days that can be worked without a day off, after the working time directive has been opted out of, any guidance would be appreciated,
Is it once you have opted out you can please yourself ?
Is it a minimum of 8 hours rest between shifts?
is it based on a risk assessement depending on type of work?
what are the breaches in the law likely to be ?
would we be in breach of our duty of care allowing employees to say, work 28 days with out a day off?
Thanks in advance James

Welcome to the forum. Have a look at this: http://www.legislation.gov.uk/uksi/1998/1833/made/data.pdf Specifically regulations 10, 11, 23 & 24. There is no 'opt out' of regs 10 & 11. Also, have a look at this: https://www.fleetnews.co.uk/blog/entry/risk-senior-management-could-face-prosecution-following-double-fatal/53557/ This is what can happen when it goes seriously wrong...
