Occupational Exposure Limits (New TWA and STEL )

Hello, According to the Commission Directive (EU) 2017/164 and regarding the new TWA and STEL “Article 7” “Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 21 August 2018 at the latest.”
As EC Directive must be adopted by the member state before coming into force.
Until this moment, the document “EH40/2005 Workplace Exposure Limits” hasn’t been updated by the HSE.

EH40 was last revised in 2011. The 2018/2019 HSE Business Plan states that they are looking to republish EH40 in Q2 of this year, this suggest that one is due very soon.

Directives do not become UK law until go through a UK legislative procedure, typically a Statutory Instrument. As the date for transposing this has come and gone the UK is in trouble and we might well be summoned to the EU Commission to explain themselves. Public bodies (wide term in EU law) are expected to apply the Directive anyway. What happens on Brexit Day? Nobody knows-fun thought!

When it comes into force, how long we will have to update for example the gas monitors? What will happen on the Brexit day? Not allot. Most of the EU Directives are in fact ILO and other international bodies recommendations.

The latest version of EH40 has been updated to include new and revised workplace exposure limits (WELs) introduced by the 4th Indicative Occupational Exposure Limit Values (IOELV) Directive.
