Im currently looking for non construcution realate case studie dealing with section 37 for our seinor level invovement program. 

 preferably in an education set in the last 10 years.

I cant find alot and it might be a lost cause but if any one should have any idea where to look it would be you guys.

Thanks For the link we have already been there, ideally we need case studies involving Universities or student unions.

Since you've already looked at the HSE prosecutions database, you'll have discovered that what you are looking for is sparse, and probably non-existent as regards your precise specifications.

Hi Charlotte

Peter is quite right. You need to have a data base like the lawyers but there are some cases which will give you a steer-nothing uni oriented except for Northumbria University's drug experiment which went wrong and left them with a £400k fine but section 3  rather than s 37. You could modify the circumstances and pitch these higher up the management hierarchy if you are looking to encourage your senior managers.

There is also R v Chargot 2008- look up s 37 offence by Mr G H Ruttle [director] - and R v P 2007-director failing to stop kids being carried on fork lift trucks. Director should have been aware of what's going on -senior management in universities too should be aware.

Don't forget R v Boal to work out who's subject to s 37

Depands really on what your objectives are?

You could just say that there are no education based prosecutions for a breach of Section 37 of  the Health and Safety at Work Act so far but do you want to volunteer?
