Hi.We have an employee who is reliant on an oxygen machine.Her doctor said she is fit enough to work.She uses this oxygen machine constantly at home and during every break period at work.She cant walk more than 20 metres  without needing a rest.I need some advice if anyone can help.She also collapsed at home.Im concerned she might collapse at work. I really dont think she is fit enough unfortunately.Thanks in advance

and your medical expertise came from....

If the employee considers themselves fit to work and their GP agrees then if you have any concerns all you can do is seek referral to an Occupational Health specialist for an expert opinion.

Reading between the lines of your post a "capability dismissal" needs a sound basis to avoid litigation.

You need to focus on more realistic issues rather than “she might collapse”.  For example if there was a fire evacuation what should she need to do?   Would you need to look at relocating her to a different office? Is this a “reasonable adjustment”?  What sort of oxygen equipment is it? Does it pose any risks (from fire etc) to others in the building?  Does she carry it with her when she goes home or leave it at work? Someone, somewhere has to decide whether any modifications that the business needs to carry out are reasonable. They might have to stand up in an employment tribunal and explain why they are not.

Thankyou.Its an oxyegen machine she uses.Its kept in her car.I have develpod a risk assessment for her.Also the extra duty of care she needs.Its a factory she works in too.She has been allocated a chair etc
