Hi, Had unfortunate accident at my site. Agency staff had his hand injured and going to be off for two weeks. As such the case reportable under RIDDOR. I was wondering whos responsibility it is to report this? Agency that agency worker works for or we as a site?

Hi the guidance is here which may help but for me the accident occurred on your site, under your control, it will be your accident investigation so the onus is on you. Unless I am taking too simplistic an approach

This question often crops up on this site & there are often differences of opinion as the answer is not that straightforward.
If the agency worker is actually employed by the agency, then they are legally obliged as the employer to make any notification under RIDDOR.
However, if the IP is self employed, then it will be down to your organisation to do so.
I would suggest that you check out the agreement between yourselves & the agency just in case this gives any clarification.

Just in case you are reading iosh where is that definitive guidance gleaned from the plethora of RIDDOR posts on this forum. OP - do you pay the worker or the agency? If you pay the worker your RIDDOR, if you pay the agency they are the employer responsible for reporting.
Simple way to gauge - who will arrange the alternative pair of hands during the absence. Employers would be directly aware if one of their employees were absent for more than 7 days - NOT the case for a business using agency stafff employed by others (OK they may let you know but that is courtesy not necessity). What about a non-employee going to hospital for treatment?
It may be that there could be two requirement to report. Dont you just love RIDDOR...

Surely it cannot be beyond the wit of IOSH to come up with clarification on this RIDDOR issue. They may have to set up a working party to look at it, maybe even pay some “experts” but that is surely what we pay our dues for?
