Hi

Having an issue trying to convince someone that a Botex log loading trailer requires a LOLER inspection.

They have been given advice that it is not required as long as RAMS are in place and a PUWER inspection is carried out.

I have trawled through the ACoP and HSE guidance and am certain it needs one. 

Does anyone have any experience of this?

Does it meet the following definition? If so, LOLER applies -

“lifting equipment” means work equipment for lifting or lowering loads and includes its attachments used for anchoring, fixing or supporting it;

This is an open frame trailer with high sides which are just "spikes" to retain the logs.

Attached to this is basically, using a trade name a "Hiab" crane fitted with a hydraulic grab.

The primary use of the grab is to hold logs.

The primary use of the mounted crane is to lift logs off the floor and into the trailer.

Whilst being lifted by the crane, they are held by the grab.

So the grab holds the load that the crane lifts.

Hmm, primary use seems lifting to me, so LOLER.

Including the grab as it is not part of the load, it would also come under the Supply of Machinery Safety Regulations, the crane would need DoI, the assembly a DoC, and thus also checking under PUWER.

See HSE info sheet LOLER: How the Regulations apply to forestry AIS29, now withdrawn but guidance remains relevant. Lists machinery included in the Regs -" Machines fitted with log loaders such as forwarder"s, which is the name for the bit of kit you're describing.
