Question: My client installs bath and bed hoists. This tends to be carried out by one engineer. The installation requires a load test in accordance with LOLER Regulations. Can the same installing engineer perform th LOLER inspection??

It was my understanding that a competent engineer is able to install and commission etc. and provide you with the necessary documentation. The same engineer is also able to undertake routine maintenance and inspection of the equipment, but any Thorough Examination should be undertaken by a separate person. This then provides impartiality for the Thorough Examination and certification as the same person is not inspecting their own work. I have worked in construction and for plant equipment that was subject to PUWER and LOLER this was carried out and taught to us by a CITB instructor during my Testing and Inspection (including Thorough Examination of plant) course.

LOLER does not expressly preclude the person carrying out the maintenance from also conducting the thorough examination. However, the competent person who carries out the thorough examination should not normally be the same person who performs routine maintenance operations on the equipment except where the risk of injury to others is low. This is to ensure that there is independence between the thorough examination and the maintenance and to avoid an individual examining their own work.

Whilst that is what I was alluding to. Any certifing inspection body must be (for the UK) UKAS accredited and adhere to BS EN ISO/IEC 17020:2004. In particular they must have risk assessed the inpartiality elements of being an accredited inspection body and a installation/maintenance provider. It can be the same company but that same company must be able to demonstrate impartiality between inspections etc as per the standard.
