So a member of staff who drives a work vehicle is hit by a 3rd party (confirmed 3rd party at fault). Said member of staff is off for more than seven days with whiplash, would this be riddor reportable?

Unless not on a public road, ie happened in your yard. Even though a driver may admit fault, if in yard it could also be down to layout!

But as Roundtuit states if pubic road and both in vehicles at time ( ie not loading / unloading) then not reportable.

Providing it was on a public highway as said not riddor - if a 3rd party crashes into you on your company carpark/delivery yard it may be riddor if layout was to blame.

As said if the accidents was on a public highway it is not RIDDOR. Also not that RIDDOR is not an admission of liability, it is simply a requirement to report such Dangerous Occurrences to the HSE. The main reason they collect this is to create statistics but they may also investigate the incident. The follow-up investigation is where fault is decided; RIDDOR itself is neutral.

To add to what AK has said, HSE investigate a tiny fraction of the incidents that are reported to them whether under RIDDOR or otherwise, e.g. via complaints.
