Lately I have noticed a big increase in absence due to depression. I know that absence caused or made worse by work falls under RIDDOR after 3 days absence - does the same apply in the case of depression casued or made worse by work?

Unless things have just changed RIDDOR relates to physical violence not none-physical violence and any 3 day absence claimed from a none physical event e.g trauma must be appraised by a specialist doctor [Not an average GP!] prior to any action is taken by us mear mortals; and even then its not RIDDOR reportable otherwise RIDDOR would be swamped with stress and similar cases

Call the HSE help desk and I am sure that they will confirm

[GP's have recently been given new strengths etc so watch this space]

Bob I have to completely disagree with you, and before I go any further I have stood in front of over 1500 people at a conference and argued that stress is not reportable under RIDDOR as it is a symptom which manifests its way differently in everyone from to much pressure.
Depression is a known illness, it is a mental condition which someone can suffer without suffering from stress, and is treated completely differently. So therefore if the depression can be pinpointed to work then it would be reportable IMO.

Ken firstly I have made it clear that stress isn't reportable, and with the greatest respect the list you provided is only for diseases?
Amputation wasn't mentioned either, so are you saying that if someone had an accident at work and lost a limb it wouldn't be reportable because its not on the list??

Amputation is, in fact on the list of reportable injuries, which is on another section of the legislation, the link had the list of reportable diseases.

SCHEDULE 1
MAJOR INJURIES
1. Any fracture, other than to the fingers, thumbs or toes.

2. Any amputation.

3. Dislocation of the shoulder, hip, knee or spine

I think that you will find that no psychological type disorders are reportable under current legislation.

Amputation isn't a industrial disease though! it's on the major injuries list...

(b)requiring resuscitation, or
(c)requiring admittance to hospital for more than 24 hours

Ken most people suffering from depression end up hospitalised for a period of time (clutching at straws here)!

I would take a look at your stress management policy to see that you are identifying your stressors and you have adequate controls.

It would be interesting to see what the ICC says. I just used the search function on the L73 guidance and there appears to be no mention of stress, depression or 'mental'. Not sure where that leaves us though! On the face of it I suggest that neither stress or depression is reportable.

This is a great site and we are all here to learn/keep up to date; NB: I am not being funny etc here; I am just making a genuine comment

However I must say that RIDDOR; after confirming again today with the HSE [just in case my old head had finnaly given up] does not cover none physical events irrespective of any mental condition thereafter that causes lost time

Stress, is, & never has been reportable under RIDDOR.

The clue is in what the "I" stands for!
