We are currently looking to tender for a new Legionella/Water Treatment Contract to help comply with L8 however under CDM would this be notifiable. The contract will cover over 400 sites and will only be for carrying out a risk assessment, quarterly, six monthly and annual checks. Any Remedials will be covered separately under CDM and notified if required. We are unsure whether we will need to notify as the project will be over 12 months and obviously under CDM for a construction project this would be notifiable. Is there any reasons due to the number of sites or the works undertaken that would mean this contract would not be notifiable?

I do not believe that sampling or risk assessing water for Legionella/Water Treatment comes under CDM Regs. Any remedial work might be CDM, but I doubt it would be a large enough project to be notifiable. If I am wrong I'm sure someone will correct me.

I would suggest not. You are not carrying out construction nor design works. I would be surprised if the remedial works are notifiable. More than 30 days construction work, or 500 person days of construction work. I would suggest reviewing each individual site to see if they meet the above to require notification. The F10 notification is relevant to individual sites.
