Do the HSE/LA inspectors measure the h&s performance of a company objectively? For instance, is there a checklist they use for deciding whether to use an informal warning, EN, or prosecution based on a points scoring system? I'm thinking for checking whether the company has a H&S Policy, RAs, and so on, and of course the suitability of these documents. Thanks in advance. Ray

HSE Enforcement policy is published on their website. As I recall, any proposed enforcement decisions are objectively considered against an employer's response and reaction to previous interventions only. LA EHO Inspectors should be working to the same policy and protocols.

Along with the Enforcement policy there is a the EMM or Enforcement Management Model / VEMM Virtual ....which is basically a process map that should be followed, to be honest it is used to justify the decision the inspector has already made through experience and judgement rather than followed blindly to its conclusion which leads to either no action or a prosecution outcome on most occasions!
