I hear that the Public Consultation on HSE Cost Recovery will be available for comment from July to October 2011 with the intention that the charging will go live April 2012 even though there are other legislative hurdles to pass.
The intention is that Material Breaches will be cost recoverable but that Technical Breaches will not.
As yet there is no final definition of either category.
The principle being the non compliant will pay following the pollutor pays in environmental legislation.

I suggest the costs to administer this proposal will far outweigh any financial benefit.
There will surely be appeal processes, costs in pursuing those who don't or won't pay etc.
All in all, this is simply a bad method of enforcement.
Hopefully this one won't get past the consultation phase. I certainly don't envy the HSE in having to put forward some sort of balanced and costed argument!
