Looking to complete a Fire Risk Assessment using the PAS 79 form and within the Relevant Fire Safety Legislation section the form refers to
The following fire safety legislation applies to these premises: The legislation is enforced by:
The property is a commercial business in Scotland so would the fire safety legislation be the Fire (Scotland) Act 2005 and the legislation be enforced by the local HSE and the regional Fire Department?

The legislation you require to work to would be the Fire Scotland act 2005. The enforcing body would be the HSE, however if you had a fire event and the local fire and rescue servic e attended, they would probably do a follow up visit and ask to see the fire risk assessment to ensure that it covered all the relevant sections of the assessment fully.

Fire Service is usually the Enforcing Authority, the LA on occasion, but not HSE. Section 61 of the Act refers.
