we are due to start a project and the principle contractor does not work weekends can the priciple contractor appoint my site engineer who is competant and trained in site managment as the responsible person.

Page 42 of the CDM Approved Code of Practice Para: 175 states: What Principal Contractors don`t have to do: principal Contractor`s don`t have to undertake deatiled supervision of Contractor`s work.

There is no reason why your Site Engineer cannot do this role you are proposing.

The answer is that the Principal Contractor can appoint BUT does not have to do so. It is his choice if he wishes to take the responsibility of a contractor working on site without his presence and something goes wrong.

If agreed there needs to be a detailed set of arrangements concerning the scope of work and limitations, emergencies, contact details, hours of work etc.

You may find he is restricted by external constraints such as client rules and planning requirements

Presumably the Principal Contractor is aware that you are going to work weekends? If so, and they have not objected or offered anyone, then there should be nothing to concern you. I would be more concerned if I was representing the PC in case of site inductions, emergencies, security and so on.

BTW it is Principal...not principle. :)
