Following on from a recent post I am now looking at L143 Work with materials containing asbestos. Although the ACoP is helpful I still do not completely understand health surveillance. The Regulations state: 22-1a) a health record, containing particulars approved by the Executive, relating to each of his employees who is exposed to asbestos is maintained However the ACoP guides: 346- The employer must keep a health record for any employee who undertakes licensable work
Does this mean that non licensed asbestos does not require health surveillance?
My operatives do not work with asbestos but are often in environments where non-licensed asbestos has become physically damaged to carry out inspections of residential and commercial properties for insurance companies; they are trained to undertake asbestos sampling on non-licensed materials.
Any help would be appreciated.

You'll find relevant info in HSG247 p19-21. Note that this Guide still refers to old CAWR Regs, I understand though that this section on medical exam is still relevant. I think this will need further amendment if HSE are successful with current proposals for amendment to CAR and proposal for new category of non-licensed notifiable work.
