CAn anyone give some guidance on the following:
I have an employee who has had an accident at work and injured his leg he has been signed of for 2 weeks by the doctor but the individual wants to work from home ie on his laptop. Am i right in thinking this would only be allowed if the indiviual had a leeter from his doctor declaring him to be fit to work from home.

Yes and no. This situation doesn't need a letter (there is often a cost attached - my last one £65 for a pretty unimpressive paragraph!) The new Med 3 has an option to advise 'may be fit' and the Dr could then go on to specify homeworking, and ideally this would be the way to go. However, even if the Dr were to say 'not fit', the new guidance from the DWP is that the advice is not binding and the employee/employer could agree terms for a return to work in some capacity The DWP guidance also says that concerns over ELI shouldn't stop this practice.

This appears to be the ideal situation for the doctor to do his job and issue a fit note with reasonable adjustments.
It may be more of an HR / insurance issue. In the past if an employee was signed off as unfit for work then I would refer them back to the doctor (if they wanted to work)for a proper fit note with a suggestion of the work they could do or reasonable adjustments needed for them to be able to come back to work . Without this I wouldn't allow them to work as there is a risk that the company would not be fully protected by the insurance company.
I would also suggest that a risk assessment is carried out for the particular work this employee would be doing.

A fit note issued by their GP would stipulate limitations for 'return to work' which could accommodate working from home.
