hello, once i remind myself, a commercial shop was being refurbished, i observed worker was not adopting any safe system of work,( might be not his fault), was it observable/ notifiable under HSE legislation or will it be considered as domestic?? there could be asbestos risk!!! because dismantling of walls was under process.
just for a thought......

By definition work on a non-domestic property, such as a shop, would be deemed commercial work and fall under the auspices of the CDM Regs as well as other h&s legislation. Whether it is a notifiable project as per CDM will depend on the whether the threshold of 30 days or 500 person days is exceeded.
Not sure why you thought a SSoW was not being implemented, however an asbestos survey may been undertaken prior to the refurbishment process - then again, it might not. Not the first or last time asbestos regulations have been breached.
