Hello All, Would the like-for-like replacement of all light fittings in a commercial building constitute as construction works, therefore subject to the CDM Regulations, or would it be deemed as maintenance?

By my understanding, what you suggest wouldn't fall into the definition of construction work under Reg 3 of CDM. Have a read at the ACOP though just to double check.

Thanks for the reply Alex, It does state in Appendix 1 that construction work includes; (e) the installation, commissioning, maintenance, repair or removal of mechanical, electrical, gas, compressed air, hydraulic, telecommunications, computer or similar services which are normally fixed within or to a structure, but I just wanted to get the general opinion to my particular situation from others.

Aye, but in that case it's got to depend on the duration and details of the project, in terms of access and re-location of staff etc.

You have answered your own question - maintenance is included in construction work and thus CDM applies. The extent and the management needs then depends on the size of the job. I have seen commercial buildings with atriums 84ft high and lighting set at the top!! Bob

An adequate management system is needed irrespective and such things as work at height, electricity at work etc. still apply so it does not really matter if it is / or if it is not CDM, unless the notification parameters apply; which looking at your posting is doubtful In my view I agree with Bob -L's comments as this goes beyond a small day to day maintenance job that does not make it a CDM job into a substantial none day to day maintenance job which does make it into a CDM job
