Hi all, Im positive that when training for this job that the Management regulations stated that all risk assessments be reviewed after accidents, changes in work practices etc etc. However on top of this they should be reviewed every 5 year regardless. I cant find where I got this information. Looking at the info in the HSE site it states: "When you are running a business it’s all too easy to forget about reviewing your risk assessment – until something has gone wrong and it’s too late. Why not set a review date for this risk assessment now? Write it down and note it in your diary as an annual event." Is the 5 year review still in law or is the HSE guidance fact now?

You are quite right to review after accidents, changes in work practices etc. You should also review on a regular basis, to be determined by yourself dependent on the residual risk. If it is low then review every couple of years for example, and if its high you could review every week if you like its up to you. There is no legal timeframe, but you need to be able to evidence that you do review. SBH

A 5 year timescale has never been law. There is fuller guidance about when to review risk assessments in the ACoP but it has never been that prescriptive - you have to decide the timescale. 5 years does sound about right as a maximum though.

I thought I would find it in the ACOP but no. The only reference I can find is in Tolleys H&S at work handbook R3023 'The frequency of such reviews should depend on the extent and nature of the risks involved and the degree of change likely. It is advisable that all risk assessments should be reviewed at least every five years'. There is no reference to this advice and my version of the book is 2008. To make things worse IDGN says review every year.

Thanks Mark, I knew I had seen the 5 year review somewhere and was certain it was law.

Do also bear in mind that there are prescriptive circumstances where a review must be conducted "forthwith" - e.g. Reg 3(3) of the Management Regs and COSHH Reg 6(3).

from HSE website Introduction It is a legal requirement for every employer and self-employed person to make an assessment of the health and safety risks arising out of his work. The purpose of the assessment is to identify what needs to be done to control health and safety risks. You should review your risk assessment: • if it is no longer valid; or • if there has been a significant change. Your workplace will change over time. You are likely to bring in new equipment, substances and procedures. There may be advances in technology. You may have an accident or a case of ill-health. You should review your assessment if any of these events happen. There is no set frequency for carrying out a review.

Best practice is to review all Risk Assessments on a regular basis, i try to review ours monthly, but alas with my work load sometimes this is not possible, however, if there were to be an accident in the mean time and your Risk Assessment did not cover changes (i know that we all feel that we have every avenue covered, but as i have found, sometimes do not), then you would be putting yourself and your company at Risk!

Rick, Just wondering why you feel it necessary to review your RAs monthly? Is your work environment particularly dynamic with regular changes to jobs and/or equipment?

We review risk assessment following any accident investigation if it identifies any changes are required and changes to current process or new process being introduced. We have just moved away from reviewing all risk assessment every 12 months to every 24 months otherwise it can just become a paper exercise. B
