Just spotted this on the BBC web site. http://www.bbc.co.uk/new...k-england-devon-17776579 I will refrain from any comment on the particulars of the case as I know nothing more than is written in the article, and as its an ongoing case I would ask everyone to remember the rules of the forum and not speculate about the issues. I do however think it make interesting reading against the backdrop of government action on school risk assessment. It also mentions that the risk assessment being carried out is being questioned does anyone know if the HSE investigated this tragic event and can they provide a link to such information? Brian

Brian Thanks for sharing the information about the case on this forum, and adding an appropriate caution against speculating about the circumstances. After seeing your posting I did some internet searching and couldn't readily find any reference to investigation of the circumstances by the HSE. This might simply reflect inadequate searching on my part. However, remember that HSE did investigate the tragedies in which young persons were swept away and drowned in swollen watercourses at Stainforth Beck (Yorkshire Dales) in 2000 and at Glenridding Beck (Lake District) in 2002 and subsequently pursued highly publicised prosecutions which resulted in convictions. Therefore, it seems likely that HSE did investigate the March 2007 tragedy at Walla Brook on Dartmoor. If so, perhaps either HSE or the Crown Prosecution Service decided from the investigation findings that there were insufficient grounds to take enforcement action under OS&H law against any organisations and/or persons. If this was the case, it may become known during the forthcoming court hearing. Therefore, those interested in the case - and any wider implications for schools and other organisations involved in outdoor pursuits - should keep an eye out for forthcoming media reports.
