Having a bit of a debate and would welcome some thoughts. Company A hires an employee to company B who then effectively control the employees working activities, hours etc. The employee then has an accident which is an LTI but the accident has been whilst carrying out the undertakings of company B. Who reports it and in terms of stats who does the LTI sit with?

If you are talking about reporting a RIDDOR +7 days to the HSE, then it would be who pays the employee direct. In this case company A, although recorded in company B's Accident Book.

Agree however should the LTI sit with Company A or Company B. My thoughts are Company B as it was outwith the control of Company A.

Turtle, My thoughts: Company A for Riddor as the employer, I lean toward company B for LTI as the works undertaken was in there control & on there premises. But the LTI could still site with company A also as a LTI of one of there employees.

The RIDDOR should be reported by A. Unless they share the same reporting system the LTI should be recorded on both databases. If it's shared it's on B as they controlled his work at that time

I agree with Dennish, "A" to report to, the stat should sit with "B". If I was "A", I would also use it for monitoring purposes.

we get the same issue with agency workers part of our agreement with them is that they record the riddor as we record agency hours as part of internal stats we show it as a LTI. and put a side note that it is an agency riddor how they record for their stats is up to them!
