Anybody know of a good & free [as this one is] HR - Employment area/law site especially with regards to TUPE?

Try the TUC website or a government website for employment law. If you type in TUPE into google it comes up with a number of sites that have the 2010 regulations for empolyers and employees.

What I have uncovered is that a H&S 'no fault' facilitating investigation for employer 'A' can be used as a discipline tool for employer 'B' even though the person TUPE'd from 'A' to 'B' has not committed a breach in employer 'B's employment but they can be made to pay for an old breach with employer 'A' even where the investigator and is not being asked about events by employer 'B' so employer 'B' has only an outline of what went on to cause the breach in the first place
This situation in my mind puts H&S investigations at risk because trust, among many other things, is lost and it looks like a murder can be forgiven but a simple H&S failure cannot
I have this info from the very top inclusive of ACAS and similar!

While TUPE is of its nature an intriguing carnival, in practice, the terms of liability of an employer on the 'receiving' end of the TUPE deal has scope to negotiate the degree of such liability so that it's not as definitive as you state.
