Hi Guys/Gals Can anyone point me into the right direction when it come to the (main) legislation currently surrounding fire safety in Scotland. In England I have a list of HASAWA 1974 MHSAW 1999 RRFSO 2005 Occupiers liability Act 57 and 84 PUWER 98 Electricity at Work 1989 etc etc Just need help with what would be the equal to say RRFSO and Occupiers Liability Act Thanks

In Scotland it's the Fire safety (Scotland) Regulations 2006 http://www.firelawscotla...6feb.html?pContentID=239 FYI, the main legislation in England and Wales is the RRFSO (2005) - and that's it. Yo might want to consider DSEAR, but as you are listing 'main' legislation, I'd drop the rest

There's also the Occupiers' Liability (Scotland) Act 1960 which sets out broadly the same obligations. However there are differences regarding lawful visitors and the extent of liability.

Hi all Thanks for all your replies. The thing is, I looked into the legislation surrounding Scottish law on Fire Safety and the first site I came across was the link messyshaw has posted. That link leads to the Fire (Scotland) Act 2005 and the Fire Safety (Scotland) Regulations 2006. But, cannot see any major differences that would effect the implementation of a policy for fire safety for a company that works in both England and Scotland. Can anyone tell me if there is any differences between the English and Scottish Acts/Regs apart from the way they are arranged. Lizzie - What are these differences? DP - I am drafting a Fire Policy for my company. We mainly operate in England but the company originates and still works in Scotland. I was just establishing the legislation surrounding Fire safety in both countries before establishing guidance etc for the compiling of the documentation.

Hi jarsmith, Occupiers' Liability in Scotland does not distinguish between lawful visitors and tresspassers. It also extends to loss or damage to property as well as to death and personal injury (it extends only to death or personal injury in England).

The principle difference in the fire legislation is the RRFSO mentions 'responsible person' and the Scottish legislation mentions persons responsible dependant on the extent of their control of the premises. My advice would be to create a single policy but mention the alternative country's legislation and identify who has responsibility for overall fire safety.
