One of our employees has suddenly had a ganglion cycst appear on his wrist while carrying out his normal duties at work, and on attending his GP he has been given a fit note to rest it for a week. I cant really beleive his GP has done this, but my question is does this need reporting under RIDDOR if his absence goes over the 7 days. Thanks Russell

Is the Dr of the opinion that the cycst has been caused by a work related factor? If not work related, then is it reportable?

I would say NOT reportable as cysts have many causes and are not always work related. They can be however and linked to WRULDs IMHO it's not reportable as a >7day as it wasn't caused by a single incident. And it's not reportable as a disease as it's not listed in schedule 3 ttp://www.legislation.gov.uk/uksi/1995/3163/schedule/3/ Although ref WRULD see http://www.hse.gov.uk/research/misc/silman.pdf Still worth investigating and seeing if repetitive work was a causative agent?

What is the gents normal task?? I dont think its a RIDDOR as such.

Mmmmmmmm, right, do you carry out Occ Health Surveillance??? Has the gent ever stated pain in his wrist prior to this appearing?? And has the GP offered any other info?? Rest alone over one week wont cure this I dont think. I think this is a OHS issue.

We carry out regular monitoring and nothing has been mentioned by the FLT driver. I also have our Occy Health Doctor on site this week and he will review the case. Funnily enough the injured person had a similar 'incident' excactly the same time last year (and he had no holiday emtitlement left) and had a week off then with a strain. I think we need to investigate a bit deeper. Thanks for all comments Russell

As such? :) It either it is or it isn't -I'm going with NO as it's not a specified disease and it's not an incident. As I stated cysts have many causes, one of which WRUL related, sounds like the Doc will sort that one out. I don't think cause is an issue - it's down to if it's specified within the regs.

"Now you only have to report injuries that lead to an employee or self-employed person being away from work, or unable to perform their normal work duties, for more than seven consecutive days as the result of an occupational accident or injury (not counting the day of the accident but including weekends and rest days). The report must be made within 15 days of the accident" Does this help with your question? If it can be proven that the cyst has formed due to work and he is unable to perform normal duties then yes it is reportable. If not work related then I would say no!

OK In my opinion this is not an incident and so not reportable under reg 3 HOWEVER Schedule 3 - No 8 and 12 - both relate to WRULDs caused by repetitive movement. If the cyst is linked to cramp or inflammation of the tendons - then it may be reportable! It will be interesting to see what the occ health doctor reports. I don't think this is reportable, but always amazed at how misunderstood RIDDOR is - this confusion has made an excellent game for training though :)
