Hi,

We are taking on lease for an additional industrial premise from a landlord. This will mainly be warehousing.

I have commenced the arrangements for First aid coverage, emergency procedures, and consideration of process risk assessments for activities to be completed, however i not 100% sure where our responsbilies lay relating to 1) Fire Risk Assessments, 2) Asbestos Register 3) Fire fighting equipment provision & maintenance/inspection 4) Electrical equipment maintenance (of provided equipment, not our equipment), 5) First Aid equipment provision 6) mainteance & statutory inspection of racking & loading bays, etc

Would this be our responsibility or that of the Landlord and we simply need to take opn the daily & routine responsibilities for checking safe condition and reporting?

Might this also be left up on the terms and condition of lease agreement and legal responsibility state out within this document? This is a new one for me so wanting to check before I proceed anyfurther

Not strictly my area of expertise; much of this would depend on the terms of the lease but as an occupier I think you are certainly going to be responsible for the majority of these, and in particular:

Compiling Fire Risk Assessments
Maintaining an Asbestos Register if applicable
Providing and maintaining fire fighting equipment where there is none in place.
Providing first aid kit, eye wash etc

You might be reesponsible for statutory inspection of racking & loading bays, etc but check with the landlord

Hi,

The lease agreement should stipulate responsibilities. If it doesn't then you need to formally agree (document) the responsibilities with the landlord. In many cases the landlord will leave it to the occupier.

In my experience if the landlord wont pay for items 1) to 5) on your post then you need to cover it.

Hopefully the landlord has the asbestos survey & fixed electrical cert?
You will still need a fire r/a even if they provide one.

safetyman, if the premises are multiple-occupancy then some detailed agreements are needed on responsibilities for fire safety, security, traffic management, spill procedures, waste management.
