Hi On carrying out an audit i came across a couple of Belle mini dumper/loaders (basically a wheelbarrow with an engine that tips) I was expecting to see the above in the plant register but only came across the completed pre check list from the hirer. The hirer is looking into it, but i wondered if anyone else had come across the same situation Harry

Hi, I'm wondering if it's technically not covered by LOLER? PUWER applies obviously, but see paragraph 32 of the LOLER ACoP L113 - "In most cases LOLER will not apply to work equipment which does not have as its principal function a use for lifting or lowering of the type associated with 'traditional' lifting equipment such as cranes, fork-lift trucks or accessories such as chains or eyebolts." See also the rest of the paragraph which refers to a three-point linkage raising a tractor's plough. It sounds like the principal function of the equipment you describe would be transportation of a load (very much in the like a wheel barrow) as opposed to lifting, and therefore LOLER does not apply? We've not used this item of equipment, but adopting the principles set out in LOLER, the equipment would not be covered by LOLER. The dumper / loader's primary function is for carrying and decanting loads. You could argue that there is not even a lifting oepration being conducted. In any case a statutory inspection in line with PUWER should be conducted by a competent person and an inspection report provided. usually PUWER inspections are conducted annually unless a different frequency is determined by risk assessment.
