At work a trained operator was trying to position a scissor MEWP when one of the stabilizer failed to extent fully during preparation. The MEWP had been utilized earlier the same day, but, was unable to extent the fourth stabilizer on this occassion. Should this be reported under RIDDOR?

The thing should not be used. The machine should be removed from site. If no accident occurred then all is well as far as I can see. No 'near miss' as the machine was not used (or was it used? Then if so, why?)
