Hi all. A quick question we have been asked. I think I know the answer, but would like your thoughts first. This is based on carrying out a home survey prior to selling/buying houses.

"Has a member of staff have the right to ask home owners/tenants to stop smoking while he/she is carrying out an assessment of their property? During an inspection the properties being assessed are essentially their work place."

Having recently worked for a large Local Authority where many of our employees had to enter people's homes, the answer was yes, i.e. this scenario was built into our Smoking Policy.

However, there were several pragmatic hoops to go through before an abject refusal to go in, & from my experience, the "softly softly" approach seemed to work.

You can certainly ask, but the home owner isn't obliged to comply with your request.
Of course, those of us familiar with the domicile of the heavy smoker(s), are aware that merely refraining for the period of your visit doesn't necessarily ensure a smoke free or wholesome environment !!!

LAs have a wee bit more 'leverage' here, where the client is routinely supported by home carers etc. on daily basis.

When I worked for LA's in Swansea and Cardiff we sent letters to our tenants asking them to refrain from smoking and hour or so before our people were due to call. If, on arrival, the tenants were smoking or chose not to refrain then our people did not have to carry out the work.

Thanks Guys. just as I suspected. I agree with the softly softly approach as the tenants are our customers.
