Hi,

Is anyone aware of case law that specifically relates to failing to assess the competency of a contractor (i.e. establish due diligence) please?

A search on the IOSH Forum didnt show up any results.

Any help would be gratefully appreciated.

You could trawl the HSE cases databases for CDM Client Duty breaches. I seem to recall something there (although most seem to relate to asbestos management failings).

Hi - There are many cases relating to this.

As I work in education, I have used this one = http://www.shponline.co....assroom-demolition-death

However, one of the most clear cut cases which spells out the need to assess a contractor is McTeare Vs Dooley and others =http://www.oneillshe.com/chas-applications/contractors-and-the-law/

After a lot of convincing, we now have a beter contractor management system in place (better than 'letting your fingers do the waliking' !).

I am sorry to be a bit vague but try and find the prosecution of the local council who installed an inflatible artwork and 2 people died when it broke from its moorings. It was somewhere like Durham.
