A service user without capacity strikes a Care Assistant and fractures her cheekbone,she will lose no work and spent less than 24 hours in hospital .Reportable or not.
I realise a similar injury caused by one service user to another service user or visitor is not reportable but the CA was acting in the course of her employment and received a fracture other than fingers toes or thumbs

Reportable!

RIDDOR says "‘Accident’ has been defined as including ‘an act of non-consensual physical violence done to a person at work’. This makes injuries to workers arising from such acts reportable if they fall into one of the categories in regulation 3(1)(a),3(1)(b), 3(2) or 4 (Page 17)

Reg 3(1)b states- any person at work suffers a major injury as a result of an accident arising out of or in connection with work;

Thanks David ,it is much as I thought,the confusing part is the only way to report it is as a major injury and a fractured cheekbone hardly falls into that category !

10mark - agree with David H - Reportable.

If you haven't got a copy already you might find HSIS 1 (rev1) - Reporting injuries, diseases and dangerous occurences in health and social care: Guidance for employers as useful aide memoire.

OK it is out of date because it refers to over 3 day but you will get the drift.

It's ANY fracture (excluding fingers & toes) that's reportable, 10mark.
