I work for an organisation that provides care to elderly people in the community. We provide equipment, including lifting equipment, that may be used by our employees and/or our clients and their carers. LOLER clearly applies to the lifting equipment when used by our employees. Section 3 duties apply when the equipment is used by the client or their carers. My question is, what are others doing to satisfy the section 3 duty to, so far as reasonably practicable, prevent clients/carers being exposed to risk when using this equipment - in particular bath lifts or bath hoists?
