We are currently building new student accommodation with retail space on the ground floor. The retail space is being let out to various high street retailers and all will be contained within their own separate demise. To what extent do we have responsibility for ensuring that the operations of these tenants doesn't negatively impact on the safety of students living within the accommodation above? We own and will operate the building as landlord, collecting rent from both the tenants and student residents. A landlords Fire Risk Assessment will be undertaken covering all common areas. Happy to hear from those in a similar position or having dealt with landlord/commercial tenant responsibilities.

I would have thought terms of standard commercial lease, along with a regime of periodic inspection of the commercial premises would satisfy your obligations. Similar should apply in respect of the domestic apartments. Some crazy things happen in domestic premises too. I seem to recall a recent story of a tenant who'd had his electricity cut-off operating a diesel (or was it petrol?) generator in his multi-storey flat............
