I have asked the HSE via email but there auto reply says they will respond within 30 days and I need to know today.
I recently downloaded a COSHH template from the HSE to use and on the form the following statement is made with reference to the hazard identified section,
*If the substance has a R45 (May cause Cancer) or R49 (May cause cancer by inhalation) risk phrase or a H350 or H350i (May cause cancer) hazard statement, it must also be registered on your personal carcinogen return (at Occupational Health) where exposure is not adequately controlled.
What is a personal carcinogen return and is it kept in house or does it have to be submitted to someone externally?
A swift response would be very helpful

Many thanks for the response, i have looked at the links and downloaded some of the documents for reference. Still none the wiser as to what that statement is asking. For now I have left it out of my assessments.

It sounds as though you are talking about a health record.

COSHH defines what needs to go into the health record. They need to be kept for 40 years. They are not submitted to an external body.

I now have COSHH in front of me. The requirement is buried in Reg 11. The details of what needs to be done are in the accompanying code of practice.
It is not the clearest bit of legislation, and it took me a great deal of time to compile the logic tree in the document cited above. Note that this is not 100% complete, as it was customised for an employer which simply does not do some of the things that are mentioned in COSHH. Those things were therefore omitted.
