This query in some ways may be similar to the chainsaw post that is currently being debated, however I am not sure of where we (the company) stand. Our maintenance staff do not ordinarily do welding on site but it transpires one member of the team does on occasion take small pieces home to weld/fabricate in his own time outside of work hours. The piece he has been working on would then be brought in to work sometime later to be fitted. He is not paid for the work out of hours and we have no control over what he does at home. He does it as a good will gesture and there is no compulsion. Would/could the company be held liable if he were to have an accident at home whilst making something for work purposes? I'd be interested in your views.

I would think because the company is 'party to these arrangements' e.g. know its happens and allows it to happen without any intervention may well have some liability.
