How is the responsibility for loads seen in law, for example a large steel cylinder 1m diameter 5m long weighs 3 tonne. Lorry backs into factory under our crane, to help the driver we use our equipment to put the cylinder onto the lorry. Is that the end of our input into the event and the responsibility then sits with the driver. Or have we failed in our legal responsibilities

The responsibility to ensure the load is secured and meets the requirements to move it on the road is that of the driver. If he takes an insecure load onto the highway he can receive an on the spot fine from the Police or VOSA. He is also responsible if the vehicle exceeds its permitted axle weights.

The driver will ultimately have responsibility for the load once it is under his care; however everyone involved will have a duty to ensure the load is secured correctly. This will include the loading point whilst the vehicle is still on your site. Good communication is required between both parties. If there was a incident police/VOSA as well as looking to the driver would look to the loading points procedures competence etc.
