hi All hoping some one can clarify for me, I read that the Client has to appoint the CDMC under regulation 14 of the CDM Regs, but we are the designer, manufacturer, and principle Contractor for the project that we are quoting, the client has asked that we also appoint and pay for the CDMC, is this allowed under CDM Regs? as I cant find any other than it is down to the client to appoint the CDMC in the Regs. thanks in advance

Mick It appears the Client has appointed you as the CDMC by asking you to supply a CDMC. What ever you do make sure the Client puts it in writing. It is not unheard of that one contractor does it all, I've recently come across a situation where the Client does every thing Design, build and CDMC role.

Do clarify with the Client. I don't believe the Client can escape the duty to ensure a competent appointment. No need for separate appointment of course, you can undertake CDM-C role yourself - but your Organisation must be in a position to demonstrate necessary competency.

I suppose we are missing the real point here? The Client has asked for Mick's company to appoint the CDM C - and pay for the CDM C. I wonder if the CDM regs mean the Client should appoint and pay for, and this client is trying a fast one to avoid the costs?

Mick Client can contract out its statutory responsibilities but not responsibility for checking that such delegation works. R v Derby City Council

Very good point indeed peter gotch - currently involved with a recent major accident. After visit from the HSE I think the Client now wishes he'd found out a great deal more about CDM & his responsibilities.
