Our wagon loads are always weight checked to ensure we don't overload ! each pallet is individually weighed off and marked accordingly. The problem being the guys who have to manhandle them off and around the wagon feel they are to heavy ! Transport manager discriminates against any driver /employee who questions the load , result they just do it and get injured in the process, 2 claims pending ,reasoning process with the manager has failed, he states his job is to get the load out at the correct weight HE DOES THIS is there any documented argument I can use to convince him .

I bet his job description says he has to manage the job safely -clearly thats not happening. Certainly HSAW gives him duties to do so and also on the company to enforce him to fulfil his duties.

What sort of wagons are you talking about? (Trains or Trucks) Do you have manual handling aids like Pallet trucks, Fork Lift Trucks, conveyor belts? What sort of set up?
