Simple question, if you are working as the clients health & safety advisor and they state that a contractor due to health & safety can not use one of their sub-contractors - should the clients H&S advisor give the reason for this, since in my case they do not think they have to.
Instead of any legal action i should take, was looking for Health & Safety reasons why they should answer the questions i have asked and supply me all relevant paperwork showing where my sub-contractor have breached any health & safety regulations.
I am at the stage now having had to deal with this person for over a year, where at any opportunity they have, they have tried to have us over on H&S grounds and at every attempted i have shown them to be incorrect on every attempt and they have ended falling flat on their faces, so would love to know of a process of reporting them.

Hi RLC, difficult one to answer without knowing the history but personally I would be looking for justification as to why a particular subbie cannot be used. Documentary evidence should be made available that will contradict any pre-qualification checks that your organisation has made in relation to this particular contractor before a decision is made. Unfortunately it can very quickly become a policital game, so in my oppinion if you have an approved list of contractors and second teir suppliers are subjected to the same processes I would pass it up the line and let the big boys fight it out.

Thanks for the reply - yep we are using other subbies to carry out works for us, and there reason for stopping us using the other subbie is that they think it will cost us money.
I will still play the game with them and now request freedom of information, under the act. Since it relates to us.

I agree, as the Client if I don't like the sub-contractor you wish to use for what ever reason then I don't have to have them on my site, but I would, if commercially allowed inform you why.
However I have worked for several PC's and it is very frustrating when the client tells you who you can and can not employ but won't tell you why especially after you have engaged them. And then also says there's no such thing as a black list of contractors.
