Is there a legal responsibility to spray/identify wooden marker pegs on building sites or is this down to the individual preference of the site, advice please, a situation as arisen where an operative as fallen over a marker peg and his now away from work with shoulder damage, is the company under a legal responsibility to identify marker pegs or is this complacency on the operatives behalf

the employer has legal duties under HASAWA Section 2 (safe place of work, safe access and egress) and CDM Regulations 26 (Safe place of work). It is common practice on many construction sites to paint and "fence-off"setting-out pegs. They are a well documented trip hazard.
