I have informed my MD that we should not be holding CRB/DBS certificates and dishing them out to Clients when asked for when tendering for contracts.

Am I right in saying that the employee holds the certificate at home, not us in their personnel file?

As for us asking for DBS checks in the first place, that's another issue!!

You can hold a copy of a DBS certificate on file for your records, with the employees permission, as to giving them to Clients that is another issue altogether. When holding the certificates on file the usual Data Protection Act criteria applies. You may find the following link of use.
