We have a van driver that went to A+E with chest pains and losing his voice and was kept in overnight.
He claims that the van he was in gave him Carbon Monoxide poisoning. We sent the van off for testing but the garage fixed the problem without any air sampling and so we cannot disprove the employee claims.
Should I report this as a Riddor?

Was there a fault with the van that led to this if so , i would maybe look at before use checks to see if there were carried out, or if any defects were reported by anyone.
How long is the employee going to be of work for, if longer than 7 days then i would report to by RIDDOR

A&E will have checked his COhb levels, by oximetry or blood test. So you can prove He had elevated levels, but not the source. It could have also come from a hearing appliance in his home, before He drove the van.

You say the garage fixed the problem, what problem? What did they fix? Did they replace any parts?
You need to ask them.
Will the hospital divulge the information ?

This could be a RIDDOR as it would be classified as a ‘Major Injury’. Look at Schedule 1:Parts 7) c) requiring hospital admittance for more than 24 hours or 8) loss of conscious ness due to exposure to a harmful substance.
The hospital should tell you if this is CO poisoning as they are obliged to report work related injuries to the HSE.
