Hi please see the email below I sent to the FORS helpline: I have a query that I hope you can help with as It is preventing completion of my fleet policy regarding licence checks for new employees. According to DVLA licencing department. A EU driving licence holder who is not a British national but resides and works in the UK is permitted to drive in the UK for up to three years before converting their licence (depends on EU country status etc. but that is irrelevant here (I am excluding Irish nationals from this question as rules are different)). Penalty points accumulated in the UK within them three years will be kept on file and placed on the new licence after the three year period if a licence is applied for. If not they must cease driving. Rules are different for commercial drivers who must exchange their licence immediately, but I am referring to ordinary licence holders who will drive small company vans. So the big question is (I know It has been a long build up to it): How do I check that a foreign EU national is eligible to drive in the UK and not on a driving ban in their own or other EU country? According to the DVLA if a foreign national is banned from driving in their own native country and the licence is suspended they are then automatically banned in this country (stated by the DVLA). The DVLA do not know the answer (I have checked). If another EU country opens a file (for 3 years) like we do for foreign nationals for driving convictions then a EU national could be on bans in numerous countries! I believe we are importing a risk in to our organisation but cannot discriminate against the foreign national or mitigate the risk (we can discriminate for H&S purposes really but don’t think this will go down well) I have also rung numerous foreign embassy’s to see if I can check driver eligibility and the answer is no. For the record "FORS" stands for Fleet Operators Registration Scheme and was devised by Transport for London and is becoming a contract requirement. It stipulates licence checks for all new employees amongst over things. Any Takers? Regards Rusty
