In relation to inspection of mobile workstands and WAH2005. Am I legally bound to apply the 7 day inspection rule only if the workstand is used in a construction environment? I do have mobile stands in use and which a fall of 2 metres or more is possible. WAH states:
Without prejudice to paragraph (2), every employer shall ensure that a working platform—
(a) used for construction work; and
(b) from which a person could fall 2 metres or more.
is not used in any position unless it has been inspected in that position or, in the case of a mobile working platform, inspected on the site, within the previous 7 days.
My workstands are used for maintenance in an engineering environment, at times these may be used externally, but normally inside. All stands are mobile and built to comply with EN 1004:2004. However at present how inspection regime does not meet the 7 day rule in WAH. Rather we have in place a procedure of observational only pre-use checks which are not recorded, however any defects or safety issues arising from these checks are formally recorded.
Am I in breach and can engineering maintenance be construed as 'construction'.
